Terms of Service

These terms apply when you use this website, chat with Gaby, or work with Gabia Studio ("we") on a project. By using the site or accepting a quotation from us, you agree to them.

1. Prices and information on this site

Prices on this site are starting prices ("from"). The final price, scope and timeline of a project are set in a written quotation from our team, which reflects what you actually need.

We keep the information on this site accurate and up to date, but it is general information and may change without notice.

2. Gaby, our AI assistant

Gaby is an AI assistant that answers general questions about our services. Its answers can contain mistakes. Nothing Gaby says is an offer, a price commitment or an agreement; only a written quotation from our team is.

Please use Gaby for questions about our services, and don't use it to send spam, attempt to misuse the system, or share other people's personal data. We may limit or block use that does.

3. How a project is agreed

A project starts from a written quotation that lists the work, price, timeline and any specific conditions. When you accept the quotation, the quotation and these terms together form our agreement. If the quotation says something different from these terms, the quotation applies.

Requests that come up while the work is in progress and fall outside the quotation, such as new pages, features or extra content, are quoted separately. We charge for them only after you agree to the new quote.

4. Payment

  • 50% of the total is due before work starts; the remaining 50% is due when the work is finished and you have approved it.
  • Work starts once the first payment is received.
  • Each invoice states its due date and the bank account to pay to. Pay only to the account printed on an invoice from us.
  • Receipts above Rp 5,000,000 carry a duty stamp (meterai), as Indonesian law requires.

5. Revisions

Each project includes two rounds of revisions on the agreed scope. Further revisions, or changes that go beyond the agreed scope, are priced separately and agreed with you first.

6. What we need from you

To deliver on time, we need your materials (text, photos, logos, account access) and your feedback when we ask for them. If they arrive late, the timeline moves by the same amount.

You confirm that you have the right to use the materials you give us, and that publishing them on your website or social media does not infringe anyone else's rights.

7. Ownership of the work

Once the project is paid in full, you own the final work made for you: the designs, written content and website or app we deliver.

We keep ownership of the general tools, code components and know-how we bring to every project. You receive a permanent right to use them as part of the work we deliver to you.

Fonts, photos, plugins and other third-party items stay under their own licences. We tell you when one requires a paid licence.

Until full payment, ownership of the work stays with us.

8. Our portfolio

After launch, we may show the finished work on our website and social media as an example of what we do. If you would rather we didn't, tell us in writing and we won't.

9. Domain, hosting and other services

The quotation states whether the first year of domain and hosting is included. Renewals after that are paid by you. Services from other companies, such as domain registrars, hosting providers, payment gateways and WhatsApp, are governed by those companies' own terms.

10. Cancelling a project

If you decide to cancel a project before it is finished, tell us in writing. You pay for the work done up to that point, according to the quotation, and the payments you have already made count toward it.

11. Responsibility

We do our work with care and fix defects in what we delivered that we caused. We are not responsible for losses caused by things outside our control, such as outages at hosting providers or other third-party services, changes made by others to the work after delivery, or materials you provided.

Our total responsibility for a project is limited to the amount you paid us for that project, except where Indonesian law does not allow such a limit.

12. Personal data

How we handle personal data is explained in our Privacy Policy. If we process your customers' personal data while building or running your system, we do so only to deliver the work you asked for, and we keep it confidential.

13. Governing law and disputes

These terms are governed by the laws of the Republic of Indonesia. If a dispute arises, we will first try to settle it by discussion in good faith. If that does not resolve it within 30 days, either side may take it to the competent district court in Indonesia.

14. Changes to these terms

We may update these terms. The version that applies to a project is the one in force on the date you accepted its quotation.
